Rail Partners responded to the ORR’s consultation on outstanding matters within the Schedule 8 performance regime as part of PR23.
Broadly, the response expressed concern with the proposal to enable the performance regime to be switched off for GBR and its operators, without information on a replacement incentivisation scheme. The response also recognised that in extreme circumstances may wish to reopen elements of the Schedule 8 regime, however the threshold for doing this should be high to avoid destabilising the regime and creating uncertainty for private operators.
